Amendments to Title 7 VSA §239(c)

With the many law changes that have taken place during the 1999-2000 legislative session, I would like to inform all liquor licensees of the following amendment that pertains directly to you.

Under Title 7 VSA §239(c) the following amendment will take effect July 1, 2000:

(c) [It shall be the responsibility of each licensee to] Each licensee shall ensure that every employee who is involved in the sale or serving of alcohol beverages completes a training program approved by the department of liquor control before the employee begins serving or selling alcoholic beverages and at least once every 24 months thereafter.  Each licensee shall maintain written documentation, signed by each employee trained, of each training program conducted.  A licensee may comply with this requirement by conducting its own training program on its premises, using information and materials furnished by the department of liquor control.  A licensee who fails to comply with the requirements of this subsection shall be subject to a suspension of no less than one day of the license issued under this title.

We have prepared an alcohol certification requires free Adobe Acrobat Reader and tobacco certification requires free Adobe Acrobat Reader to be completed by the employer and the employee(s) who have been trained.  This will be the written documentation for each employee(s) and must be kept on the licensed premise.

As stated in Title 7 VSA §239(c), a licensee may comply with this requirement by conducting its own training program on its premises, using information and materials furnished by the Department of Liquor Control.  These are the following options to meet this requirement:

  1. Attend a seminar given by an investigator from the Vermont Department of Liquor Control.  Please contact your investigator or this office for other dates and times.

  2. For both first and second class licensees, there is a video available for your use to train your personnel.

  3. Our department publishes an Alcohol Servers Awareness Program booklet for both first class and second class licensees.  To obtain videos or booklets, please contact your investigator or our Montpelier office.
